Family of man killed while riding wheelchair plans lawsuit

STONINGTON, Conn. (AP) The daughter of a Connecticut man struck and killed by a car as he operated his motorized wheelchair along U.S. Route 1 in Stonington intends to sue the town.

The Day of New London reports that in a notice of intent to sue, Raymond Lanphere's daughter says her father was forced into the road because the sidewalks were in serious disrepair.

The notice says the sidewalk is uneven and pitted and one area had a dirt depression, making it impossible for Lanphere to travel in his wheelchair.

The 77-year-old Lanphere was struck May 25. He died at the hospital. The driver who struck him was not charged.

First Selectman Rob Simmons said the town is sorry for what happened to Lanphere but does not bear responsibility.
