A Judge has sided with the town of Bethel in a case over the Planning and Zoning Commission's rejection of a crematorium application.  Shawn McLoughlin applied to build a crematorium on a more than 6 acre property he owns next to his concrete business in Clarke Business Park.  The Newstimes reports that the judge ruled last week the Commission had the authority to reject the proposal out of concern that property value would be driven down in nearby residential neighborhoods and that development in the business park would have been stymied.  A zoning regulation was adopted that would have allowed crematoriums, but later repealed the amendment and rejected McLoughlin's proposal.
